Sale Agreement and Limited Warranty
We hope you, the purchaser, will enjoy your puppy
for years to come. We have taken steps to ensure
that your new puppy is healthy. Your puppy has
been selectively bred for excellent quality, health,
soundness, intelligence and good temperament.
Our puppies are from dogs exhibiting no genetic
disorders. We will have a qualified veterinarian inspect the puppy
and issue a health certificate at the purchaser’s request and expense.
Puppy will have the first set of shots (5-8 weeks). Puppy will be started
on a preventative maintenance schedule at 2 weeks. A record of these
vaccinations will be provided by us (Shaloma Loves Puppies). Your
puppy will need follow-up vaccinations, worming, flea control, rabies
vaccination and heartworm prevention as recommended by your
veterinarian.Limited Warranty:
Your puppy is guaranteed to be in good health at the time of sale. By
the term “good health,” we do not mean that the puppy will be in
perfect health. There are certain conditions which are common to small
breed dogs, and some infections cannot be predicted or prevented. We
do guarantee that with normal and routine care by you and your vet,
your puppy will enjoy a healthy and active life. Purchaser agrees to
take puppy to a licensed vet within 72 hours of leaving our
possession for an examination to ensure puppy is in good
health at time of delivery. Shaloma Loves Puppies is to be
faxed & mailed a copy of the Veterinarian’s examination within
24 hrs of Vet Exam. If a Vet does not see the puppy within 72
hours, Purchaser waives all benefits afforded to Purchaser in
this Guarantee.
In the unlikely event of an emergence of any genetic disorder within the
first 24 months of the puppy’s life, which is sufficiently serious to the
puppy’s health, and in the opinion of your veterinarian, the puppy
should be euthanized (put down), then to qualify for a replacement:
Send us a letter from your vet on his letterhead which confirms that he
has recommended euthanizing this dog, that this dog has received
regular checkups and was not overweight for its height/structure. YOUR
VET MUST STATE THE HEALTH PROBLEM AND INCLUDE A
DESCRIPTION OF THE SYMPTOMS SUPPORTING HIS OPINION. The
registration papers for the dog must be sent to us and transferred to
our name. The dog must never have been used for breeding, not be
overweight, and must still be with its original owner. You must notify us
the day of initial examination to make
claim for a replacement puppy. The original puppy must be returned
(alive) within 24 hours along with all paperwork. If you choose
euthanasia without our prior consent you will forfeit any guarantees
within this contract. You agree to fill out all necessary forms to return
ownership of puppy to us.
After these qualifications have been met, we at Shaloma Loves Puppies
agree to replace the dog. If you qualify for a replacement puppy, we
will provide a new puppy of equal value, if one is available. If you
choose a puppy of greater value, you are responsible to pay the
difference.
The warranties stated in this document are the only warranties given in
connection with your purchase. There are no other warranties.
Specifically, the warranty of merchantability or of fitness for a particular
purpose are disclaimed & not given.
Use of the Dog/Puppy:
It is agreed between Shaloma Loves Puppies and purchaser, whose
name is signed below, that this dog is being acquired as a family
companion dog or as a therapy dog. The parties to this contract agree
that the dog is not purchased for resale nor will it be used or trained for
activities which are illegal or for which it is not suited by reason of
temperament or conformation.
Shaloma Loves Puppies makes no guarantees of your puppy’s mature
size, or that it will be show, or breeding quality.
Growth and Development:
Because of canine illnesses for which vaccinations do not
provide protection, we require that all dogs be kept on “NuVet
Plus Canine.” If your puppy is not kept on NuVet, Purchaser
waives 12 months of benefits afforded to Purchaser in this
Guarantee. This Nutritional Supplement is only available through
breeder recommendation. You will be instructed concerning this when
you take possession of your puppy. It is best to order this early enough
so that you will have it on hand before you take your puppy home.

Shipping Agreement:
Shipping costs and risks will be borne by the purchaser and third-party
shipper, unless otherwise stated in writing by Shaloma Loves Puppies.
Title to the puppy passes to purchaser when it is entrusted to a third
party shipper. We can supply the following at Purchaser’s expense:
Health certificate, shipping kennel and transportation to airport in order
to facilitate delivery. The shipping kennel becomes the property of
purchaser. In the event that a refund or replacement of the dog is
required, such refund or replacement does not include shipping or
transportation costs. If a dog must be returned, all shipping and
transportation costs are at the expense of purchaser.
Purchaser Responsibilities:
The purchaser agrees to maintain the dog in a humane environment
and properly train and care for it. The dog will not be allowed to roam.
We strongly recommend you provide permanent identification
by tattoo or microchip. We at Shaloma Loves Puppies give
permission to be listed as an alternate contact on micro-chip
registration information.
Because of the high quality of Flint River Ranch dog food
products we require that your puppy be fed the Flint River
Ranch Puppy/Dog Food exclusively. This All-natural, Premium,
Oven-Baked Kibble is important for immune system, bone and
cartilage development. Purchaser waives 12 months of benefits
afforded to Purchaser in this Guarantee if other food is used.
In the event that the purchaser is unable to keep the dog or provide an
appropriate home, the dog may be returned to us. This is not an offer
of refund but an offer to assist in re-homing the puppy/dog.
Puppy Stress and Other Conditions:
Shaloma Loves Puppies does not guarantee against conditions that
may be triggered by stress related from the move to a new home or by
the shipping process. Conditions not covered in this guarantee include
luxating patella, hydroencephelitis, coccidia, giardia, kennel cough,
Dirofilaria immitis, upper respiratory infection and any parasitic
presence at time of purchase. As these are unpredictable in nature,
these are conditions that occasionally occur, regardless of the level of
care that is given to the pups prior to leaving our home.
Notify Shaloma Loves Puppies Immediately:
We must be contacted immediately should the puppy become ill. The
purchaser agrees to get medical attention for the puppy by a licensed
Veterinarian in the event of illness. The purchaser also agrees to
keep the puppy current on all vaccinations and de-worming treatments.
By signing this agreement, you as the purchaser are also
acknowledging that you accept total responsibility for the special care
that may be needed for the very tiny puppies that may experience
hypoglycemia. Treatment for this condition can be quite expensive, but
is almost always totally preventable if proper care instructions are
followed. This is extremely serious and can result in disability or death
for the puppy if proper care is not provided by purchaser.
Re-Homing Responsibilities:
By signing this contract you are agreeing that it is your responsibility to
place this puppy in a new, appropriate home, regardless of financial
compensation if:
1. Your living situation changes and you are no longer able to have
pets.
2. You change your mind for any reason and do not wish to have the
puppy as part of your family.
3. We at Shaloma Loves Puppies determine that you are not
taking proper care of the puppy or dog.
Safeguarding Your Puppy:
It is also your responsibility to safe guard your puppy’s health and
obtain medical treatments for it when needed. We are not responsible
for vet fees, treatment costs, transportation costs, training costs,
stress, or other expenses. All sales are final and irreversible with the
only exceptions being those as stated above.
Terms of Agreement: The undersigned acknowledges that this as a
legally binding document. This document constitutes the full agreement
between Shaloma Loves Puppies and purchaser. The terms, conditions
and remedies in this contract take precedence over any other
communication or representation, whether written or verbal, and
constitute the whole agreement between Shaloma Loves Puppies and
purchaser.
Deposits are non-refundable. The deposit is meant to be a down pmt
on the purchase of a puppy or dog from Shaloma Loves Puppies. If
purchaser decides not to purchase a puppy/dog from Shaloma Loves
Puppies they forfeit the deposit and will not receive the $200 non-
refundable deposit amt.
Purchaser agrees to pay any court costs, and/or attorney fees incurred
by Shaloma Loves Puppies to uphold this agreement. This contract is
governed by the laws of the state of Texas and is deemed to be
executed and entered into in the state of Texas. Any dispute arising
between the parties hereto concerning the meaning or interpretation of
this agreement, or the rights, duties, or obligations of the parties to this
agreement shall be submitted to and determined by a court of
competent jurisdiction in Bell County, Texas. I, the Purchaser, am a
competent adult, I have read and understand the above guarantees
and information regarding this puppy, and I agree to the terms in this
contract in full.
